WITNESS HELD 84 DAYS GIVEN $76 BY COUNTY

Henry Smith, held in the county jail 84 days as a witness against Magdalina Werner and Frank Piconi, who were acquaitted of the murder of Henry Werner, was allowed a fee of $76 today by Judge Frater on the basis of one dollar a day, $8 witness having been deducted previously.

Attorney A. G. Cauthorn petitioned for a fee of $2 a day for 95 days and was denied it by the court. Judge Frater declared that the law of the state empowered the prosecutor to hold a witness without a fee, but that he agreed it was just that some recompense be made.
